Estate Planning /Administration

Pamela E. Whitaker offers estate and trust administration services to personal representatives, trustees, beneficiaries, and creditors of an estate. If you have lost a loved one, Pamela will be sensitive to your personal and legal needs as we handle the final affairs of the deceased. Pamela is fluent in the complexities of North Carolina probate laws, estate taxes, and other issues that often arise during estate and trust administration.

In North Carolina, a personal representative is nominated during the process of drafting a will. If you have been named the personal representative of your loved one’s estate, you have been given an important responsibility. If a will cannot be located, Pamela E. Whitaker will assist you in determining who should serve as the personal representative. Pamela can provide advice and counsel as we assist you with these responsibilities, including:

  • Collecting the decedent’s assets
  • Paying debts and taxes
  • Filing the appropriate inventories and accountings
  • Distributing the remaining assets to the named beneficiaries

Pamela handles the administration of both probate and non probate assets, including assets held in trusts. She also represents individuals who have been named trustees to an estate. Trustees have many obligations to fulfill as well including distributing assets to beneficiaries, maintaining accurate accounting logs, and paying taxes on behalf of the estate.

Pamela handles any litigation that may arise during the course of estate and trust administration, including will contests, creditor claims, and breach of duty actions against personal representatives, trustees, and others with fiduciary responsibility.
